DISCLAIMER AND LIMITATION OF LIABILITY

  1. Assumption of Risk. By purchasing, using, or operating this product “Cart Keeper”, the purchaser and/or end user acknowledges and accepts that products containing heating elements inherently carry risks, including but not limited to fire, burns, electric shock, property damage, and personal injury. The User voluntarily assumes all risks associated with the installation, operation, and use of the Product.

  2. Intended Use. This Product is designed solely for use indoors in a dry, cool area and under direct supervision at all times in accordance with the instructions provided by Cart Keeper. Any use of the Product outside of its intended purpose, or contrary to the operating instructions, constitutes misuse and voids any and all warranties, express or implied.

  3. No Modification. The Product must not be altered, modified, or repaired by any person other than the Cart Keeper company. Any unauthorized modification or repair voids warranties and releases Cart Keeper from all liability.

  4. Indemnification. The User agrees to indemnify, defend, and hold harmless Cart Keeper, its officers, directors, employees, agents, suppliers, and distributors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

    • The User’s misuse, negligence, or improper operation of the Product;

    • Failure to follow provided instructions or safety warnings;

    • Unauthorized modification or repair of the Product;

    • Use of the Product with non-approved accessories or power sources.

  5. Limitation of Liability. To the maximum extent permitted by applicable law, Cart Keeper shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or loss of data, arising from or related to the use of the Product. Cart Keeper’s total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the purchase price of the Product.

No Waiver of Legal Rights. Nothing in this Disclaimer shall limit any non-waivable statutory rights granted to consumers under applicable law.
